This license is a legal agreement between you and Escape Motions for the use of Rebelle software (the "Software").
By downloading, installing, copying, or otherwise using the Software, you acknowledge that you have read terms and conditions of this license,
understand them, and agree to be bound by them. If you do not agree with these terms and conditions,
Escape Motions is unwilling to license the Software to you, and you are not authorized and may not use the Software.
Definitions
"Animation" means the automated generation of two (2) or more sequential frames intended to be assembled into motion content including but not limited to video or moving image files whether frames are saved individually or as a video file, broadcast, streaming content, live performance or real-time visuals, and whether produced via Rebelle Motion IO, Rebelle’s WebSocket Control, scripting, or any other automation interface.
"Commercial Use" means any use intended for or resulting in monetary or other commercial advantage, including sale of artworks, commissions, paid installations, client work, advertising, sponsorship, or promotional material for a business or product.
"Animation Interfaces" means Rebelle Motion IO, Rebelle’s WebSocket Control, and any other API or mechanism that enables automated execution of painting commands for frame-based output.
"Project Budget" means the total production budget allocated to motion content for a single project (including VFX/animation), whether internal or external.
"Organization Revenue" means the legal entity’s total annual gross revenue or funding for the most recently completed fiscal year.
"Production Triggers" means any one or more of the following conditions are met:
a) Organization Revenue: The Animation is produced by or for a legal entity with total annual gross revenue or funding exceeding USD $200,000. For the avoidance of doubt, when an Animation is created by a contractor, freelancer, or agency for a client (a "work-for-hire" or commissioned scenario), it is the annual gross revenue of the client (the final owner or beneficiary of the work) that determines if this trigger is met.
b) Project Budget: The total production budget for the project in which the Animation will be used exceeds USD $100,000. This refers to the budget of the entire final production (e.g., a feature film, an advertising campaign, an episode of a series, a game cinematic), not just the portion of the budget allocated to a single contractor or a specific task.
c) Organization Size: The Animation is produced by or for an organization with 20 or more employees.
1. Permitted Use
You are licensed to use the Software as expressly set out in this Licence from your first use of the Software until termination of this
Licence. The Licence granted to you is limited, non-transferable and non-exclusive.
Except to the extent any rights cannot be excluded by law, you are permitted:
1.1. Rebelle, Trial Version
to download, install only the number of copies of the trial version ("Trial Software") required for the evaluation.
Users evaluating the Trial Software may use the Software only for personal, non-commercial internal use.
Trial Software is a free evaluation version of the Software. It is made available to you solely for the purpose of demonstrating the program
capabilities of the Software for a limited time period which varies and is specified in the offer terms (the "Trial Period").
It may not include the full functionality found in the full version.
You must purchase a full license to be able to continue the use of the Software after the expiration of the Trial Period.
Any attempt to circumvent any expiration date technology is in violation of this EULA and will automatically and immediately terminate your license to use the Software.
1.2. Rebelle and Rebelle Pro, Standalone License
a) if you are a private individual, to download, install three (3) copies of the Software directly on a computer running Microsoft Windows
("Windows Computer") or macOS ("Mac Computer") that you personally own or control provided that not more than one of those
computers is in use simultaneously. A standalone license purchased by a private individual allows using the Software for commercial,
or for-profit activities as well as for personal, non-commercial, or non-profit activities.
b) if you are a commercial enterprise, to download, install, use and run one (1) copy of the Software for use by one individual or
multiple individuals on a single shared Windows or Mac Computer that you own or control. For example, multiple employees may use
the Software on a single computer used as a shared resource. A standalone license purchased by companies or commercial
organizations allows using the Software for commercial, or for-profit activities as well as for personal, non-commercial, or non-profit
activities.
c) if you are a school, educational institution or other non-commercial organization, to download, install, use and run one (1) copy of
the Software for use by one individual or multiple individuals on a single shared Windows or Mac Computer that you own or control.
For example, multiple employees may use the Software on a single computer used as a shared resource. A standalone license
purchased by schools, educational institutions or other non-commercial organizations allows using the Software for non-commercial,
or non-profit activities unless it is otherwise stated in the Agreement concluded between You and Escape Motions.
1.3. Rebelle and Rebelle Pro, Floating License
if you are a school, educational institution, company, or other organization of more than one person, to download and install the
Software on any number of Windows or Mac Computers that you own or control. The number of users that may use and run the
Software at any one time is limited to the number of licenses purchased.
You may not permit the number of individual users simultaneously logged in to the Software to exceed the number of floating seats
permitted by the license to the Software purchased by You.
a) A floating license purchased by schools, educational institutions or other non-commercial organizations allows using the Software for
non-commercial, or non-profit activities unless it is otherwise stated in the Agreement concluded between You and Escape Motions.
b) A floating license purchased by companies or commercial organizations allows using the Software for commercial, or for-profit
activities as well as for non-commercial, or non-profit activities.
1.4 Animation Output License (Motion IO and WebSocket Control)
a) Non-Commercial Animation: You may use the Animation Interfaces to create Animation for personal, non-commercial, or educational use at no additional cost.
b) Standard Commercial Animation (no additional license required): You may use the Animation Interfaces to create Animation for Commercial Use without a separate Animation license if none of the Production Triggers in this Agreement are met. This allowance is intended for individual artists, freelancers, small studios, and independent creators, and applies whether Animation is created via Rebelle Motion IO or Rebelle’s WebSocket Control.
c) Production/Extended Commercial Animation (separate license required): If any Production Trigger is met, you must obtain a separate, project-based Animation license from Escape Motions prior to using the Animation Interfaces for that project. Please contact us at

d) Third-Party Companion Applications and Tools Developers may create and distribute companion applications or tools that interface with the Animation Interfaces, provided that:
- The Software is not bundled, redistributed, or sublicensed;
- The tool is clearly identified as a third-party tool requiring Rebelle;
- The tool does not circumvent or obscure the licensing tiers or restrictions in this Agreement; and
- End users’ use of such tools with Rebelle complies with this Section 1.4, including any requirement to obtain a separate Animation license when Production Triggers are met.
e) No Circumvention: You may not structure a workflow to avoid this Section, including by exporting sequential still frames for later assembly into motion content. For the purposes of this Agreement, such output is "Animation".
1.5 WebSocket Control: Security and Responsibility
By enabling the WebSocket Control feature (via command line parameters), you accept full responsibility for securing your environment, including restricting access via IP address and configuring appropriate firewall rules. Escape Motions is not liable for unauthorized access resulting from unsecured WebSocket configurations. All usage of WebSocket Control must comply with this Agreement, including Section 1.4.
2. Software Updates
In short, your license includes one year of feature updates and two years of bug fixes for maintaining the conformity of the purchased version of the Software, at no extra cost. Details are explained below.
2.1. Update Period
Your purchase of the Software license (whether a new license or an upgrade from a previous version) includes a 12-month update period at no additional cost. This entitles you to all Software updates released during this period, which may include bug fixes, security patches, performance enhancements, and new features.
2.2. Long-Term Support (LTS) Version
To ensure the long-term conformity and security of the Software, we are committed to providing a Long-Term Support (LTS) version of Rebelle. This is in accordance with applicable consumer protection laws, including EU Directive 2019/770, which requires us to provide updates necessary to maintain the software conformity.
Entitlement: During your 12-month update period, at least one version of the Software will be designated as an LTS version. The LTS version will contain all features available up to its point of release, and your license grants you perpetual access to it.
Support Period: This designated LTS version will receive critical bug fixes and security updates necessary to maintain the Software's conformity for a period of two (2) years from the official release date of that LTS version.
Scope of LTS Updates: In line with EU Directive 2019/770, two-year obligation to provide these critical fixes is limited to the features and functionality that were available in the Software at the time of your purchase. While the LTS version you receive may contain newer features than the version you purchased, the legal commitment for bug fixes applies to the feature set you acquired at the time of purchase.
New Features: Once a version of the Software is designated as an LTS, it will not receive new features or major enhancements. To receive new features released after your 12-month update period has expired, you may purchase a renewal (see Section 2.4).
2.3. After Your Update Period Expires
Your license to use the Rebelle software is perpetual. After your 12-month update period expires, you may continue to use any version of the Software you were entitled to during your update period, including the LTS version, indefinitely. You will continue to receive all relevant critical bug fixes and security updates for your designated LTS version until the end of its two-year support period, at no additional cost.
2.4. Renewing Your Update Period
To receive new features and enhancements after the 12-month period has expired, you may purchase a renewal of the update period. Renewal is not required to continue using the software versions you already own or to receive the entitled support for your designated LTS version.
3. Restrictions
This is a SINGLE COPY SOFTWARE LICENSE. The Software is copyrighted and protected by law and international treaty. This is a license,
not a transfer of title, and unless you have been granted prior, written consent from Escape Motions you may not:
a) Reproduce, distribute, or transfer the Software, or portions thereof, to any third party.
b) Sell, rent, lease, assign, or sublet the Software or portions thereof.
c) Grant rights to any other person.
d) Modify, decompile, reverse engineer, disassemble, or create derivative works based on the Software or the documentation in whole or in part.
e) Use the Software in violation of any international law or regulation.
You must not intentionally or unintentionally make the Software available on any web server, ftp server, file sharing network, shared
directory, or other location where any other person can acquire a copy of the Software. You are responsible for keeping the Software
safe from being copied by others.
4. Display of Copyright Notices
All copyright and proprietary notices and logos within the Software files must remain intact.
5. Indemnity
You agree to indemnify and hold harmless Escape Motions for any third-party claims, actions or suits, as well as any related expenses,
liabilities, damages, settlements or fees arising from your use or misuse of the Software, or a violation of any terms of this license.
The Software may contain technical inaccuracies or typographical errors, so changes and/or updates may be affected without notice.
Escape Motions may also make improvements and/or other changes to the Software at any time without notice.
6. Disclaimer Of Warranty
THE SOFTWARE IS PROVIDED \"AS IS\", WITHOUT WARRANTY OF ANY KIND, EXPRESSED OR IMPLIED, AS TO THE SOFTWARE OR ITS
OPERATION, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY,
OR FITNESS FOR A PARTICULAR PURPOSE. FURTHER, ESCAPE MOTIONS DOES NOT WARRANT THAT THE SOFTWARE OR ANY RELATED
SERVICE WILL ALWAYS BE AVAILABLE.
7. H.264/AVC License Notice
To the extent that the Software contains AVC encoding and/or decoding functionality, commercial use of H.264/AVC requires additional
licensing and the following provision applies: THE H.264/AVC FUNCTIONALITY IN THIS PRODUCT IS LICENSED HEREIN ONLY FOR THE
PERSONAL AND NON-COMMERCIAL USE OF A CONSUMER TO ENCODE VIDEO IN COMPLIANCE WITH THE AVC STANDARD ("AVC VIDEO")
AND/OR DECODE AVC VIDEO THAT WAS ENCODED BY A CONSUMER ENGAGED IN A PERSONAL AND NON-COMMERCIAL ACTIVITY
AND/OR AVC VIDEO THAT WAS OBTAINED FROM A VIDEO PROVIDER LICENSED TO PROVIDE AVC VIDEO. INFORMATION REGARDING

8. Limitations Of Liability
YOU ASSUME ALL RISK ASSOCIATED WITH THE INSTALLATION AND USE OF THE SOFTWARE. IN NO EVENT SHALL THE AUTHORS OR
COPYRIGHT HOLDERS OF THE SOFTWARE BE LIABLE FOR CLAIMS, DAMAGES OR OTHER LIABILITY ARISING FROM, OUT OF, OR IN
CONNECTION WITH THE SOFTWARE. LICENSE HOLDERS ARE SOLELY RESPONSIBLE FOR DETERMINING THE APPROPRIATENESS OF USE
